Inter vivos trust registration in South Africa

General information about registering an inter vivos trust with the Master of the High Court, including jurisdiction, core documents and trustee authority.

Which Master’s office usually has jurisdiction

The Department of Justice states that an inter vivos trust must be registered with the Master in whose area of jurisdiction the greatest portion of the trust assets is situated.

If more than one Master may have jurisdiction, the official guidance states that the Master in whose office the trust was first registered continues to have jurisdiction.

Core registration documents

The Department of Justice lists documents including the original trust deed or a notarially certified copy, proof of the applicable fee, the J401 application form, and acceptance forms for trusteeship and the auditor.

The official trust page also lists identification and beneficiary documentation requirements. Missing documents or inconsistencies in the trust deed can slow the registration process.

Trustees may not act before authority is issued

The Department of Justice expressly states that no trustee may act as such without the written authority of the Master. That makes the registration stage critical before any administration starts.

A properly prepared trust file therefore matters not only for speed, but also for compliance from the outset.

Ongoing compliance matters

The official trust page also notes that trustees should keep accurate financial statements and comply with their fiduciary obligations. Additional beneficial ownership record and reporting obligations may also apply.

Trust registration should therefore be approached as the beginning of an ongoing compliance relationship, not just a once-off filing exercise.
